Terms of Service

These Terms of Service ("Terms") govern your use of the Peptary mobile application, peptary.app, and related services (collectively, the "Service"). In these Terms, "Peptary," "we," "us," and "our" refer to the operator of the Service.
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and legally capable of entering into these Terms to use the Service. The Service is not intended for children or minors.
What Peptary Does
Peptary is an informational tool for performing user-directed peptide-related calculations and keeping personal records. Features may include calculating concentrations, amounts, volumes, and syringe units; saving calculation profiles and history; recording doses; viewing locally derived statistics; and importing or exporting records.
Peptary does not prescribe, supply, recommend, administer, or verify any peptide, medication, treatment, or injection. Peptary is not a healthcare provider, pharmacy, laboratory, medical-device manufacturer, or emergency service.
Medical and Safety Disclaimer
Peptary does not provide medical advice, diagnosis, treatment, prescribing, dosing instructions, or clinical decision support. The Service is provided only for general informational calculation and personal record-keeping purposes.
You must not use Peptary as a substitute for advice from a licensed physician, pharmacist, or other qualified healthcare professional. Do not start, stop, change, prepare, combine, or administer any peptide, medication, supplement, or injection based solely on information or calculations produced by the Service.
All results depend entirely on the information you enter. Incorrect amounts, units, concentrations, syringe settings, component selections, dates, or other inputs will produce incorrect or unsafe results. Software defects, rounding, device behavior, or misunderstood units may also affect a result. Before relying on any result, you must independently verify every input, unit conversion, concentration, dose, volume, syringe marking, and output with a qualified healthcare professional and any applicable official product information.
The Service does not determine whether a substance is lawful, genuine, sterile, safe, approved, compatible, properly stored, or appropriate for any person or purpose. References to peptides or other components do not constitute endorsement or a statement of regulatory approval.
Never delay seeking professional care because of information shown in Peptary. If you believe you may have taken or administered an incorrect amount, experienced an adverse reaction, or have a medical emergency, stop using the Service and immediately contact local emergency services, a poison-control center, or a qualified healthcare professional.
You assume responsibility for decisions and actions taken using information from the Service. If you are a healthcare professional, you must independently exercise your professional judgment and comply with all laws, professional standards, and institutional requirements; the Service is not validated for clinical use.
Local Processing and Storage
Peptide-related calculations are performed on your device. Peptide names and amounts, calculation inputs and results, calculator history, profiles, presets, dose or injection records, dates, statistics, and notes are stored in the app's local database on your device when you choose to save them.
Peptary does not upload this data to our servers and does not provide or operate cloud synchronization or cloud backup. However, your device's operating system may back up app data according to your device, account, and backup settings. Any such system-level backup is controlled by you and the relevant platform provider, not by Peptary. The data is not sent by Peptary to third-party cloud services for calculation or storage, and Peptary does not use it for advertising, analytics, or marketing.
If you export, share, or transfer a local file, you are responsible for the destination, recipient, security, and later use of that copy.
Because we do not possess a Peptary-operated server-side or cloud copy, we cannot view, recover, correct, export, or delete your locally stored peptide-related data. You are responsible for protecting your device, maintaining any local exports you need, and managing or deleting records through the app. Deleting the Peptary app removes its local database and all peptide-related records stored by the app from that device. Depending on your operating-system and backup settings, a system-level backup may retain or later restore app data. Peptary cannot access, control, or restore such a backup. Files that you previously exported or shared are separate copies and are not deleted when you delete the app.
You retain any rights you have in your locally stored data. Entering, calculating, or storing that data locally does not transfer ownership to Peptary and does not grant us a license to use it.
Purchases, Lifetime Access, and Future Subscriptions
Peptary currently offers a one-time in-app purchase for specified paid features. The exact product, price, currency, taxes, included features, and any other material terms are shown in the purchase screen before you confirm payment.
A product described as "Lifetime" or "Permanent" means non-expiring access to the features included in that purchased product for as long as Peptary continues to offer and support those features. It does not guarantee that the Service, every feature, or compatibility with every future device or operating-system version will remain available forever, and it does not automatically include separate products or services that may be offered in the future.
We may offer auto-renewing subscriptions in the future. If subscriptions become available, the purchase screen will clearly identify the subscription period, included features, full renewal price, billing frequency, any trial or promotional terms, and how to cancel before you subscribe. Unless otherwise stated at purchase, a subscription will automatically renew for the same period until you cancel it through the applicable marketplace account settings. Cancellation stops future renewals but does not normally provide a refund for the current billing period, except where required by law or marketplace policy.
Adding future subscription options will not convert an existing one-time purchase into a recurring subscription or cause an existing one-time purchaser to be charged automatically. Any subscription requires a separate, affirmative purchase confirmation.
Purchases are processed by the applicable marketplace, such as the Apple App Store, and purchase entitlements may be managed through RevenueCat. We do not receive your full payment-card details or marketplace password. Marketplace terms govern billing, payment authorization, taxes, cancellations, chargebacks, and refunds. Refund requests must generally be submitted to the marketplace, subject to your rights under applicable law.
You may restore eligible purchases using the restore-purchase functionality provided in the Service and the same marketplace account used for the original purchase. Restoration depends on the marketplace receipt, RevenueCat entitlement data, product availability, and marketplace rules.
We may change prices or the features included in products offered for future purchase. Any price change for a future subscription will apply only as disclosed by the marketplace and applicable law. We will not retroactively impose a recurring charge on a completed one-time purchase.
License to Use the Service
Subject to these Terms, Peptary grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Service for lawful personal or internal business purposes.
The Service, including its software, design, interfaces, text, graphics, calculations, organization, and other materials provided by Peptary, is owned by or licensed to Peptary and is protected by applicable intellectual-property laws. Except where applicable law does not permit the restriction, you may not copy, sell, sublicense, distribute, publicly display, reverse engineer, decompile, interfere with, or create derivative works from the Service without our permission.
You retain ownership of feedback you provide, but you grant Peptary a non-exclusive, worldwide, royalty-free, perpetual license to use suggestions or feedback to improve and operate the Service without an obligation to compensate you.
Acceptable Use
You may not:
- Use the Service in violation of any law, regulation, professional duty, or third-party right;
- Use the Service to facilitate unlawful acquisition, distribution, prescribing, preparation, or administration of controlled, unapproved, counterfeit, or otherwise unlawful substances;
- Attempt to bypass purchase controls, access restrictions, security measures, or usage limits;
- Introduce malware or interfere with the operation, security, or availability of the Service;
- Use automated tools to scrape or extract Service content except where we expressly permit it; or
- Misrepresent Peptary calculations as medical advice, a prescription, regulatory approval, or verified clinical guidance.
We may restrict access to online or paid features when reasonably necessary to protect the Service, comply with law, respond to fraud, or enforce these Terms. Such restrictions do not give us access to peptide-related data stored locally on your device.
Service Availability and Changes
We may update, add, remove, suspend, or discontinue features of the Service. We do not guarantee that the Service will always be available, error-free, compatible with every device, or supported indefinitely. Updates may change calculation behavior or data formats. You should review results again after an update and maintain any local exports you consider necessary.
Privacy
Our Privacy Policy explains how information is handled. Peptide-related calculation and record data remains locally stored as described in these Terms and the Privacy Policy. Purchase providers, website providers, and other third parties may process limited non-peptide information under their own terms and privacy practices.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. Peptary disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and availability.
We do not warrant that calculations or records are complete, accurate, clinically appropriate, free of rounding or unit errors, or suitable for any medical decision. No statement in the Service creates a doctor-patient, pharmacist-patient, fiduciary, or other professional relationship.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, Peptary and its owners, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business, goodwill, or device use, arising from or related to the Service.
To the maximum extent permitted by law, Peptary's total liability for all claims relating to the Service will not exceed the greater of the amount you paid for the Service during the twelve months before the event giving rise to the claim or USD $50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory consumer right available where you live.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Peptary and its owners, affiliates, licensors, and service providers harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person's rights. This section does not apply where prohibited by applicable consumer law.
Changes to These Terms
We may update these Terms to reflect changes to the Service, purchase options, legal requirements, or business practices. We will post updated Terms with a new effective date and provide additional notice where required by law. Changes will not retroactively convert a completed one-time purchase into a subscription or remove mandatory rights that apply to an existing purchase.
Your continued use of the Service after updated Terms become effective constitutes acceptance where permitted by law. If you do not agree to an update, you should stop using the Service.
Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except that mandatory consumer-protection laws in your place of residence continue to apply where they cannot lawfully be waived.
Any dispute that cannot be resolved informally will be brought in a court with lawful jurisdiction. Nothing in these Terms prevents you from using a consumer-protection authority, small-claims process, or other remedy available to you under mandatory applicable law.
Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. These Terms and the Privacy Policy constitute the agreement between you and Peptary concerning the Service and supersede prior terms concerning the same subject.
